1. Acceptance of Terms

By accessing or using the RPM Challenge website and services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Unpossible Creative Corp ("RPM Challenge," "we," "us," or "our"). By creating an account, posting content, or participating in the RPM Challenge, you acknowledge that you have read, understood, and agree to these Terms.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility & Age Requirements

Age Restrictions

You must be at least 13 years old to use the RPM Challenge Service.

Users aged 13-17: Parental or legal guardian consent is required. By creating an account if you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Your Responsibilities

By using the Service, you represent and warrant that:

You meet the age requirements stated above
You have the legal capacity to enter into these Terms
You will comply with all applicable laws and regulations
All information you provide is accurate and current

We reserve the right to terminate accounts that violate these eligibility requirements.

3. Account Registration & Security

Account Creation

To use certain features of the Service, you must create an account. When you create an account, you agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Keep your password secure and confidential
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities that occur under your account
Choose a username that is not offensive or inappropriate

Prohibited Actions

You may not:

Use another person's account without permission
Create multiple accounts for abusive purposes
Share your account credentials with others
Impersonate another person or entity
Use automated means to create accounts

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

4. Community Guidelines

Be nice, be cool, be positive, be respectful.

The RPM Challenge is an all-ages community of musicians supporting each other. We expect all users to maintain a constructive and supportive atmosphere.

Immediate Ban Offenses

Posting harmful, offensive, or illegal material will result in an immediate ban, including:

Illegal content that violates applicable laws
Harassment, bullying, or targeting individuals with abuse or threats
Hate speech or discrimination
Pornographic or excessively violent material
Spam or malicious software

All-Ages Environment

Keep swear words to a minimum
Use appropriate, non-offensive usernames
Consider that people of all ages interact here

Constructive Atmosphere

Aggressive criticism, dismissive comments, or "edgy" behavior that disrupts the creative community spirit isn't welcome here. Be mindful of how your words might come across in text form.

Provide constructive feedback, not destructive criticism
Support fellow musicians in their creative journey
Welcome musicians of all skill levels and backgrounds
Be honest - don't misrepresent your work or plagiarize

Additional Prohibited Actions

Copyright infringement - upload only music you own or have rights to
Hacking or exploiting - attempting to breach security or gain unauthorized access
Scraping or automation - using bots or scripts without permission

Reporting & Blocking

If you experience inappropriate behavior:

Block users to prevent them from interacting with you
Report content that violates these guidelines
Contact us at info@rpmchallenge.com for serious issues

5. Content Ownership & Licensing

You Own Your Content

You retain full ownership of all music, posts, images, playlists, and other content you upload to the RPM Challenge. We do not claim any ownership rights to your creative work.

License Grant to RPM Challenge

By uploading content to the Service, you grant RPM Challenge a non-exclusive, worldwide, royalty-free license to:

Display your content on the RPM Challenge website and apps
Distribute your content to other users based on your privacy settings
Create derivative works for technical purposes (e.g., transcoding audio, generating thumbnails)
Promote the RPM Challenge using your content (with attribution)

Your License Ends When You Delete

This license terminates automatically when you delete your content from the Service. We will make reasonable efforts to remove deleted content from all systems, though cached or backup copies may persist temporarily.

Content Visibility

You have full control over who can see your content:

Public: Visible to anyone on the internet
Island Only: Visible only to members of your island community
Private: Playlists can be marked private (visible only to you)
Hidden: Projects can be hidden from public listings (but still accessible via direct link)

Responsibility for Your Content

You are solely responsible for the content you post. By uploading content, you represent and warrant that:

You own the content or have the necessary rights to share it
The content does not infringe any third-party rights (copyright, trademark, etc.)
The content complies with these Terms and applicable laws

6. Content Deletion & Data Control

Delete Anytime, No Approval Needed

You have full control over your content. You can delete posts, playlists, media files, and projects at any time without requiring administrator approval. Deletion is immediate and permanent.

What You Can Delete

Posts: Delete individual posts (text, images, audio)
Playlists: Delete playlists you've created
Media files: Remove uploaded images and audio files
Projects: Hide projects from public view (or delete entirely)
Profile data: Update or remove profile information
Account: Request complete account deletion

What Happens When You Delete

When you delete content:

Content is immediately removed from public view
Media files are deleted from our storage servers
Database records are marked as deleted
Our license to use your content terminates
Cached or backup copies may persist temporarily (typically 30-90 days)

Account Deletion

To request complete account deletion, contact us at info@rpmchallenge.com. Account deletion will:

Delete all your posts, playlists, and media
Remove your profile and personal information
Anonymize your participation history
Permanently disable your account

Account deletion is permanent and cannot be undone. We may retain certain information as required by law or for legitimate business purposes (e.g., fraud prevention).

7. Island Chat & Third-Party Features

The RPM Challenge Service integrates with third-party services to enhance functionality. By using these features, you agree to comply with the third-party's terms of service.

Island Chat (ChatHack)

Island Chat is a spatial audio feature that allows island members to communicate in a virtual dungeon environment. Island Chat is powered by ChatHack, a third-party service.

Island Chat requires microphone access
Audio conversations are transmitted in real-time
We do not record or store Island Chat conversations
ChatHack's terms of service and privacy policy apply to your use of Island Chat

Other Third-Party Services

The Service may include links to or integrations with other third-party services:

Supabase: Authentication and database services
DigitalOcean Spaces: Media storage and CDN delivery
Dicebear API: Default avatar generation

We are not responsible for third-party services. Their terms, privacy policies, and practices are independent of RPM Challenge. Use third-party services at your own risk.

8. Disclaimer of Warranties

THE RPM CHALLENGE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Without limiting the foregoing, RPM Challenge does not warrant that:

The Service will meet your requirements or expectations
The Service will be uninterrupted, timely, secure, or error-free
The results obtained from using the Service will be accurate or reliable
Any errors in the Service will be corrected
User-generated content is accurate, appropriate, or legal

You use the Service at your own risk. You are solely responsible for any damage to your computer system, loss of data, or other harm resulting from your use of the Service.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RPM CHALLENGE (INCLUDING UNPOSSIBLE CREATIVE CORP, ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Service
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from the Service
Any bugs, viruses, trojan horses, or similar that may be transmitted to or through the Service
Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
User-generated content or the defamatory, offensive, or illegal conduct of any third party

Maximum Liability

In no event shall RPM Challenge's total liability to you for all damages, losses, and causes of action exceed the amount you paid to RPM Challenge in the twelve (12) months prior to the claim, or $100 CAD, whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless RPM Challenge (including Unpossible Creative Corp, its directors, officers, employees, agents, and affiliates) from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party, including copyright infringement
Your content uploaded to the Service
Your conduct in connection with the Service

This indemnification obligation will survive the termination of your account and these Terms.

11. Intellectual Property

RPM Challenge Trademarks

"RPM Challenge," the RPM Challenge logo, and other marks, graphics, logos, and service names are trademarks or registered trademarks of Unpossible Creative Corp. You may not use these marks without our prior written permission.

Service Copyright

The Service, including its design, text, graphics, interfaces, and code, is owned by Unpossible Creative Corp and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our permission.

Copyright Infringement

We respect the intellectual property rights of others and expect users to do the same. If you believe that content on the Service infringes your copyright, please contact us at info@rpmchallenge.com with:

A description of the copyrighted work you claim has been infringed
A description of where the infringing material is located on the Service
Your contact information (email, phone, address)
A statement that you have a good faith belief that the use is not authorized
A statement under penalty of perjury that the information is accurate and you are authorized to act
Your physical or electronic signature

We will investigate copyright claims and may remove infringing content or terminate repeat offenders' accounts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

Update the "Effective Date" at the top of this page
Post the modified Terms on the Service
Notify you via email or in-app notification (for material changes)

Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

Material changes that significantly affect your rights will be highlighted and may require explicit acceptance before you can continue using the Service.

13. Governing Law & Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Newfoundland and Labrador, Canada, without regard to its conflict of law provisions.

Jurisdiction

You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts of Newfoundland and Labrador, Canada. You consent to the personal jurisdiction of such courts and waive any objection to venue.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RPM Challenge regarding the Service and supersede all prior agreements.

Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
